Tenant response
The tenant has 5 days, not counting weekends or court holidays, to respond to the summons (§ 83.60). A tenant who raises a defense other than payment must also deposit the rent in the court registry.
Default
After 5 business days. File the motion for default with an Affidavit of Military Service and a proposed Final Judgment.
Final judgment and writ
Submit a proposed Final Judgment with copies for the landlord and each tenant. Without one the judge may not enter judgment. For a default, add two pre-addressed, stamped envelopes per party and three proposed Writs of Possession.
Summons in our eviction packet
Brevard’s clerk has its own English-only summons (Law 131). This packet’s summons follows the current statewide rule form. If the clerk asks for its own, use that one.
Property managers and entities
Per the clerk, a landlord’s agent (such as a property manager) may do only the initial filing unless the agent is an attorney.
