Response, default and judgment.
- Tenant response
- The tenant has 5 days, not counting weekends or court holidays, to respond to the summons (§ 83.60). A tenant who raises a defense other than payment must also deposit the rent in the court registry.
- Default
- After the 5 days have passed (not counting Saturdays, Sundays or legal holidays), file the Motion for Clerk’s Default, Motion for Default Final Judgment, a notarized Non-Military Affidavit and the Final Judgment.
- Final judgment and writ
- The Final Judgment in an original plus one copy for each party, with stamped, addressed envelopes. Some County Civil judges hold ex-parte hearings at 425 N. Orange Ave.: report to Room 350 between 8:00 and 8:15 a.m. with completed paperwork. The clerk enters the default and sends you to the judge’s chambers; once the judge signs, the clerk issues the 24-hour notice (Writ of Possession) and you take it to the Sheriff’s office, 2nd floor, Room 240 (407-836-4570). Bring 2 copies of the writ and the $90 sheriff check.
- Summons in our eviction packet
- Orange’s clerk packet has its own older, English-only summons (Form 63). This packet’s summons follows the current statewide rule form. If the clerk asks for its own, use that one.
- Property managers and entities
- The clerk’s packet has an Owner’s Authorization for Property Manager form. A property manager cannot be named as plaintiff, may act only for possession, and only while the case is uncontested. If it becomes contested, an owner that is a partnership or corporation must hire an attorney.
Details were read from the Orange County clerk’s published packet or fee pages in October 2026. Clerks change forms and fees, so confirm with the clerk before you file. Sources: myeclerk.myorangeclerk.com, www.myorangeclerk.com. Not legal advice.
